CalcTree Privacy Policy

CalcTree (“CalcTree”, “we,” “us,” and “our”) is a cloud-based calculation management platform allowing technical professionals to string together tools and build calculations from scratch or from existing repositories. Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and share your personal information and to assist you in exercising your privacy rights.

1. We respect your privacy

a.
CalcTree respects your right to privacy and is committed to safeguarding the privacy of our customers and software application users. We adhere to the National Privacy Principles established by the Privacy Act 1988 (Cth) in Australian jurisdictions. This policy sets out how we collect and treat your personal information.

"Personal information" is the information we hold which is identifiable as being about you.

2. Collection of personal information

CalcTree will, from time to time, receive and store the personal information you enter onto our software application, provide it to us directly or give it to us in other forms.

You may provide basic information such as your name, phone number, address and email address to enable us to send information, provide updates and process your product or service order. We may collect additional information at other times, including but not limited to; user feedback, information pertaining to your personal or business affairs, changes your content or email preference, responses to surveys and/or promotions, provided financial or payment information, or communicate with our customer support.

3. How we collect your personal information

CalcTree collects personal information from you in a variety of ways, including when you interact with us, when you access our software application and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.

4. Use of your personal information

CalcTree may use personal information collected from you to provide you with information, updates and our services. We may also inform you of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.
b.
The Application may make third-party social media features available to its users. We cannot ensure the security of any information you choose to make public in the social media feature. We cannot ensure the security of the information you provide to third parties whilst interacting with the CalcTree platform. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.
c.
CalcTree may contact you by various measures including, but not limited to, telephone, email, SMS or mail.

5. Disclosure of your personal information

We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required to deliver our services.
b.
From time to time, we may need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, or warrant, in the course of a legal proceeding or response to a law enforcement agency request.

We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of CalcTree, its application, website and customers or third parties.

Information that we collect may from time to time be stored, processed in or transferred between parties. These may include, but are not limited to:

In the case of a change of control in our business or a transfer of business assets, we reserve the right to transfer to the extent permissible by law our user databases, together with any personal and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek only to disclose information in good faith and where required by any of the above circumstances.

By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. When we disclose your personal information to third parties, we request that the third party follow this Policy regarding handling your personal information.

6. General Data Protection Regulation (GDPR) for the European Union (EU)

CalcTree will comply with the principles of data protection set out in the GDPR for fairness, transparency and lawful data collection and use.
b.
We process your personal information as a Processor and/or to the extent that we are a Controller as defined in the GDPR.
c.
We must establish a lawful basis for processing your personal information. The legal basis for which we collect your personal information depends on the data that we collect and how we use it.
d.
We will only collect your personal information with your express consent for a specific purpose, and any data collected will be to the extent necessary and not excessive for its purpose. We will keep your data safe and secure.
e.
We will also process your personal information if it is necessary for our legitimate interests or to fulfil a contractual or legal obligation.
f.
We process your personal information if it is necessary to protect your life or in a medical situation, it is necessary to carry out a public function, a task of public interest or if the function has a clear basis in law.
g.
We do not collect or process any personal information from you that is considered "Sensitive Personal Information" under the GDPR, such as personal information relating to your sexual orientation or ethnic origin, unless we have obtained your explicit consent or if it is being collected subject to and in accordance with the GDPR.
h.
You must not provide us with your personal information if you are under the age of 16 without the consent of your parent or someone who has parental authority for you. We do not knowingly collect or process the personal information of children.

7. Your rights under the GDPR

a.
If you are an individual residing in the EU, you have certain rights as to how your personal information is obtained and used. CalcTree complies with your rights under the GDPR as to how your personal information is used and controlled if you are an individual residing in the EU

Except as otherwise provided in the GDPR, you have the following rights:

to be informed how your personal information is being used;
ii.
access your personal information (we will provide you with a free copy of it);
iii.
to correct your personal information if it is inaccurate or incomplete;
iv.
to delete your personal information (also known as "the right to be forgotten");
v.
to restrict processing of your personal information;
vi.
to retain and reuse your personal information for your own purposes;
vii.
to object to your personal information being used; and
viii.
to object against automated decision making and profiling.
c.

We may ask you to verify your identity before acting on any of your requests.

8. Security of your personal information

a.
CalcTree is committed to ensuring that the information you provide to us is secure. To prevent unauthorised access or disclosure, we have put in place suitable electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.
b.
The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information you transmitted or received from us. If we learn of a security system breach, we may attempt to notify you electronically by posting a notice on the Services, by mail or by sending an email to you.

9. Access to your personal information

a.
If you are an Australian consumer, your right to access personal information is granted in accordance with this Policy and the Privacy Act 1988 (Cth). A small administrative fee may be payable for the provision of information. If you would like a copy of the information we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at contact@calctree.com.
b.
If you are a consumer outside of Australia, your right to access personal information is governed by this Policy. If seek access to your personal information or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at contact@calctree.com.
c.
We reserve the right to refuse to provide you with information that we hold about you in certain circumstances set out in the Privacy Act 1988 (Cth) and at CalcTree’s discretion.

10. International data storage and transfer

a.
All information processed by us may be transferred, processed, and stored anywhere in the world, including but not limited to the United States or other countries, which may have data protection laws that are different from the laws where you live. In the event that you are a consumer outside of Australia, we endeavour to safeguard your information consistent with the requirements of applicable laws.

11. Supervisory Authority

a.
Users have the right to lodge a complaint with their relevant data privacy supervisory authority if they believe our processing of personal information violates applicable laws. Alternatively, users can send details of your complaint to contact@calctreet.com. We take complaints very seriously and will respond as soon as possible.

12. Opt-out rights

a.
You can stop all collection of information by the Application by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email at contact@calctree.com. In circumstances where you opt-out, we may still collect and use non-personal information regarding your activities on our Services and for other legal purposes as described above.
b.
You can opt-out of receiving promotional emails from us at any time by using the “unsubscribe” link at the bottom of the email. You will still receive emails that relate to your account, products, and services that you have requested. You will not be able to opt out of any emails regarding an update to the Privacy Policy, Terms and Conditions or any other administrative notification.
c.
We may send you notifications to your mobile via “push notifications” and collect precise location information. You can opt out of these functionalities by changing your settings on your mobile device.
d.
If you use the “Do Not Track” option on your browser CalcTree will seek to honour this functionality. CalcTree will not track your online activities over time and across different websites. Please note we do not have control or access to third-party service providers who may use cookies, pixel tags, web beacons or other storage technology to collect and store Log Data or information from elsewhere on the Internet.

13. Breach

a.
Where unauthorised access or disclosure of personal information or loss of information occurs, CalcTree will assess the risk of the breach against the Notifiable Data Breaches scheme.
b.
This criteria will be satisfied if:
i.
There is unauthorised access to or disclosure of personal information held by CalcTree (or information is lost in circumstances where unauthorised access or disclosure is likely to occur).
ii.
This is likely to result in serious harm to any of the individuals to whom the information relates.
iii.
CalcTree has been unable to prevent the likely risk of serious harm with remedial action.
c.
This assessment will determine whether the breach is an eligible data breach that triggers notification obligations.
d.
If CalcTree determines there has been an eligible data breach users will be informed within 72 hours of the breach, where feasible to ensure users of the platform can change their passwords to compromised online accounts, and be alert to identity fraud or scams.

14. Changes to Privacy Policy

a.
Please be aware that we may change this Privacy Policy in the future. We may modify this Policy at any time, in our sole discretion, and all modifications will be effective immediately upon sending you, via email, an updated version of the Privacy Policy and after acceptance of the Privacy Policies updated terms.

15. Data retention

a.
We store the personal information we receive as described in this Privacy Policy for as long as reasonably practicable. This is inclusive of where necessary to allow you to continue to use our Services or where required to resolve disputes, establish legal defences, conduct audits, pursue legitimate business purposes, enforce our agreements or comply with applicable laws.
b.
All information processed by us may be transferred, processed, and stored anywhere in the world. Data protection laws vary depending on where you live and where you are using the CalcTree platform. In the event that you are an Australian user, CalcTree is not limited to the storage of data in Australia, and different protection laws may apply. Regardless of your location, we will endeavour to safeguard your information with applicable laws.

16. Software Application

a.
When you use our Application, we may collect certain information such as unique device ID, the IP address of your device, operating system, the type of internet browsers you use, and information about how you use the Application. This information is aggregated to analyse how people use our site so that we can improve our service.
b.
We may, from time to time, use cookies on our software application. Cookies are very small files that a website uses to identify you when you come back to the application and store details about your use. Cookies are not malicious programs that access or damage your computer, tablet or smartphone. Most devices automatically accept cookies, but you can choose to reject cookies by changing your device settings. However, this may prevent you from taking full advantage of our application.
c.
CalcTree may collect certain information automatically, including, but not limited to; the type of device you use, your device's unique device ID, the IP address of your device, your operating system, the type of Internet browsers you use, and information about the way you use the Application.
d.
Our software application may, from time to time, have links to other applications or websites not owned or controlled by us. These links are meant for your convenience only. Links to third-party applications and websites do not constitute sponsorship, endorsement, or approval of these third parties. As discussed above, please be aware that CalcTree is not responsible for the privacy practices of other such applications or websites. We encourage our users to be aware, when they leave our application or website, to read the privacy statements of each and every application or website that collects personal information.
